Terms of Service

Introduction and Scope

Welcome to Anescribe Preview, a free pre-release mobile application developed and owned by Anescribe, L.L.C. ("Company," "we," "us," or "our").

By downloading, installing, or continuing to use Anescribe Preview, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

Anescribe Preview is an early access preview version of the Anescribe application made available for testing, demonstration, and evaluation purposes. It is offered free of charge and may contain incomplete features, errors, or changes from time to time.

Territorial Restriction: Anescribe Preview is intended only for use in the United States. By using the app, you represent that you are physically located within the United States and subject to its laws.

Definitions

"User" or "You" means any person who downloads, accesses, or uses Anescribe Preview.

"Preview" means the free, pre-release, evaluation version of the Anescribe application.

"Content" means any text, audio, images, scans, or other material entered into or generated through the app.

"Patient Data" means any protected health information, personally identifiable health information, medical records, or other data relating to an identifiable patient.

Grant of License

Subject to this Agreement, we grant you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to install and use Anescribe Preview for lawful personal or internal business evaluation use within the United States.

You may not:

  1. Reverse engineer, decompile, disassemble, or attempt to extract source code from the app, except where prohibited by law from restricting that right;
  2. Modify, adapt, copy, reproduce, distribute, lease, sell, sublicense, or create derivative works from the app;
  3. Use the app for any unlawful, harmful, fraudulent, or abusive purpose;
  4. Use the app in any way that could damage, disable, overburden, or impair the app or related systems;
  5. Use the app to upload, store, transmit, or process Patient Data.

No Accounts; No Patient Data Retention

Anescribe Preview does not currently require user accounts.

Anescribe Preview is not intended for the storage, retention, or management of Patient Data at this preview stage. You agree not to use the app to enter, upload, dictate, scan, store, transmit, or otherwise process Patient Data or any information that identifies a patient.

The preview is designed so that no Patient Data is intentionally retained by the Company. Because this is a preview build, you understand that you should not rely on the app for any clinical, legal, recordkeeping, billing, compliance, or patient care purpose.

User Responsibilities

You agree to:

  1. Use the app only for lawful testing, evaluation, or demonstration purposes;
  2. Avoid entering any confidential, sensitive, or regulated information into the app;
  3. Keep your device secure and updated;
  4. Stop using the app if you believe it is malfunctioning in a way that could create risk.

You are solely responsible for your use of the preview and for ensuring that your use complies with all applicable laws, regulations, workplace policies, and professional obligations.

User Conduct and Legal Compliance

You agree that you will not use Anescribe Preview to:

  1. Create, store, transmit, or facilitate the distribution of child sexual abuse material;
  2. Harass, abuse, stalk, threaten, defraud, or otherwise harm any person;
  3. Violate any local, state, or federal law or regulation of the United States;
  4. Infringe the rights of any third party, including privacy, confidentiality, intellectual property, or publicity rights.

We may suspend or terminate access to the preview at any time for violation of this section.

Free Preview; No Purchase Required

Anescribe Preview is provided free of charge. No subscription fee is required for use of the preview version unless and until a future paid version is released under separate terms.

We may modify, limit, suspend, or discontinue the preview or any feature at any time, with or without notice.

Data Handling

At this preview stage:

  1. No user account is required;
  2. No Patient Data should be entered;
  3. No Patient Data is intended to be retained by the Company;
  4. Any temporary app content or technical logs, if created as part of app operation, may be deleted, reset, or overwritten at any time.

You acknowledge that preview builds may not behave like final production software and that entered material may not persist.

No Medical Use

Anescribe Preview is not a medical device and is not intended to diagnose, treat, cure, prevent, or manage any disease or medical condition.

Anescribe Preview is not intended to replace professional judgment, medical documentation systems, legal record systems, or clinical workflows. It must not be used for patient care, emergency decision-making, or any purpose requiring guaranteed accuracy, uptime, security, or retention.

Intellectual Property

Anescribe Preview, including its software, design, text, graphics, interfaces, trademarks, logos, and related materials, is owned by Anescribe, L.L.C. or its licensors and is protected by applicable intellectual property laws.

This Agreement grants you only the limited right to use the app under the terms stated here. No ownership rights are transferred to you.

Feedback

If you provide suggestions, comments, bug reports, ideas, or other feedback regarding Anescribe Preview, you grant Anescribe, L.L.C. a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback for any lawful purpose without compensation or attribution to you.

Disclaimer of Warranties

Anescribe Preview is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, Anescribe, L.L.C. disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and security.

We do not warrant that the app will be uninterrupted, error-free, secure, or suitable for any particular use.

Limitation of Liability

To the fullest extent permitted by law, Anescribe, L.L.C. and its owners, officers, employees, contractors, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, business interruption, or loss of goodwill arising out of or related to your use of or inability to use Anescribe Preview.

To the fullest extent permitted by law, the total liability of Anescribe, L.L.C. for any claim arising out of or relating to this Agreement or the app will not exceed fifty U.S. dollars.

Termination

We may suspend, restrict, or terminate your access to Anescribe Preview at any time, with or without notice, for any reason or no reason.

You may stop using the app at any time by deleting it from your device.

Sections that by their nature should survive termination will survive, including sections concerning intellectual property, feedback, disclaimers, limitations of liability, dispute resolution, and governing law.

Modifications

We may update this Agreement from time to time by posting a revised version in the app or through another reasonable form of notice. Continued use of Anescribe Preview after the updated Agreement becomes effective constitutes acceptance of the revised terms.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of New York, without regard to conflict of law principles.

Any dispute arising out of or relating to this Agreement or Anescribe Preview will be brought exclusively in the state or federal courts located in New York, New York, unless both parties agree to another method of resolution.
